Accused ones file habeas corpus writ petition

Kathmandu: Three arrested people have applied for the habeas corpus writ petition in the Supreme Court.

Accused Min Bahadur Gurung, Dharma Prasad Gautam, and Sudhir Kumar Shah applied for the petition on Thursday. The application stated that they had been arrested illegally.

All three accused have demanded in the application that they need to be released without any conditions.  People file for ‘Habeas Corpus Writ Petition’ when state agencies illegally arrest or jail them.

The petitioners claimed that they were forced to be part of the investigation of the case, even after the expiration of the time limit. The preliminary hearing on the petition would take place on Friday in the Supreme Court.

17 people in the Lalita Niwas land grab scandal gained Interim Order from the Supreme Court 15 months ago. Three arrested were released on the same day when they were arrested on Tuesday.

The petitioners are trying to follow the same path by using the habeas corpus writ petition as a shield for their release.
