Writ against dismissal of Lamichhane’s passport dispute case in Supreme Court

Kathmandu: Advocate Yubraj Poudel Safal has filed a writ petition against Rastriya Swatantra Party (RSP) Chairman Rabi Lamichhane in the Supreme Court on Monday.

Poudel had filed the complaint highlighting the point that the case of Lamichhane was dismissed illegally without proper investigation.

The writ number is 067-WO-1087. The Supreme Court has called a hearing on Tuesday.

Poudel claims that Lamichhane took a Nepali passport despite being an American citizen. Poudel had gone for registering the complaint court on Sunday. But he needed to rectify a few errors in the document.

The document mentions that the decision of the Attorney General over Lamichhane’s case appeared to be mischievous and was against the Nepalese Passport obtaining act, Section 5 (b) of 2024.

Poudel claims that decision of the Attorney General to dismiss the case that Lamichhane didn’t have any criminal mentality for making a Nepali passport was itself out of the jurisdiction.

He had demanded that the Department of Immigration must disclose in what circumstances Lamichhane had used his passport.

Poudel, by addressing the Rule 49 of Supreme Court Rules 2074, even mentioned that Lamichhane must not be allowed to use his political rights as a Nepali citizen unless there is a completion of the double discussion.
